Terms of Service
Definitions
The following text uses natural language to make sure it's easy to understand. If anything is unclear, follow these definitions:
Luxatile, the artist you are commissioning, is referred to as "Luxatile," "the Artist," or with first person pronouns ("I, me, my, mine, myself").
You, the client commissioning Luxatile, is referred to as "the Client" or with second person pronouns ("you, your, yours, yourself").
The artwork that is to be produced by Luxatile as commissioned by the Client is referred to as "the Artwork" or "the Product."
"Terms of Service" may be abbreviated to "ToS" or "the Terms."
Requirements
You must be at least 18 years of age in order to commission me, regardless of the nature of the Artwork.
You must own the rights to all characters you ask me to draw, or have explicit permission to use them.
If one or more of the characters involved in the Artwork belongs to someone else, said person must also give explicit permission for me to draw them, and must be informed of the nature of the Artwork as well. The best way to do this is to directly put me in touch with them to obtain their consent; do not send screenshots of DMs or similar.
Rights
Client's Rights
Once the Artwork is complete, the Client has the right to use it in any way they wish, while adhering to the following exceptions:
The Client may not use the Artwork for commercial purposes, such as selling it or including it in a commercial product without explicit permission.
The Client may not use the Artwork to train or otherwise interact with Generative AI algorithms of any kind.
The Client may not present the Artwork as own work.
The Client may not post the Artwork to the platform X (formerly 'Twitter').
The Client must not falsely imply that the artwork depicts illegal activities such as underage sexual activity.
The following are examples of what encompasses the Client's right to use of the Artwork:
Sharing the Artwork privately.
Posting the Artwork to social media (e.g. Bluesky), a personal gallery site (e.g. FurAffinity), or a public image board (e.g. E621), as long as Luxatile is attributed as the creator of the Artwork.
Cropping the Artwork and using it as a social media avatar, profile banner, and similar personal branding.
Artist's Rights
Once the Artwork is complete, the Artist has the right to use it for commercial and non-commercial purposes, including but not limited to:
Posting the Artwork as own work to various websites (e.g. BlueSky, FurAffinity).
Using the Artwork for commercial purposes, such as posting a full-size version for paying Patreon subscribers, using it to advertise commission work, and including it in commercial product.
When the Artist posts the Artwork, characters owned by the Client or a third party must be correctly attributed by the Artist.
The Artist will not use the Artwork to train or otherwise interact with Generative AI algorithms of any kind.
Payment Policy
You must pay for all commissioned Artwork up-front through a PayPal invoice.
You must pay all outstanding invoices before I begin work on the commissioned Artwork.
Refund Policy
By default, no refunds are given once payment has been rendered, except to correct mistakes in billing.
Other exceptions can be made at my discretion, decided on a case by case basis. It's most likely to happen if I need to cancel work through no fault of the Client, but is not guaranteed.
In cases where refunds are given, you may receive a full or partial refund. The exact amount refunded is also decided at my discretion.
